Husseyn: Salaam all.  Today is 1st Dhul Hijja 1443 (corresponding to June 30, 2022).  Day of Arafah will be on 9th Dhul Hijja (July 8th) and Eid-al-Adha on 10th Dhul Hijja (July 9th). Fasting on the Day of Arafah is not obligatory, however it's a good day to observe a nafl fast for those healthy enough to do so.  Insh'Allah.

Salam to you all.  some questions came to my mind after reading that.  If oath breaker was chronically ill and couldn't fast for 3 days and then died.  How can such a person atone?

If an oath taker is forced to break oath because of compelling reasons, can that person be excused from the penalties?

If forced to break oath due to compelling circumstances and that person is chronically ill, and (presuming) also too poor to feed or clothe the needy or free a slave, then they need to sincerely ask forgiveness from Allah Almighty putting in their best effort to refrain from getting caught in such circumstances again.  There is no other way out in this case. 

If the oath was broken due to negligence or carelessness (and not compelling situation), and at the same time the person is chronically unwell and also too poor to take care of any of the penalties, it would presumably be more dislikable in the Sight of Allah Almighty because the violation was intentional.  Well again, the person needs to genuinely repent (make taubah) and ensure never to indulge in such carelessness again.  They must have the realization for true repentance prior to passing to minimize the chances of getting into trouble in the Hereafter.

And only Allah Almighty knows best.

Offering additional nafl salah is always helpful in every difficult situation .. and even otherwise.  But the person's heart must be sincere and honest.  After the salah, they need to earnestly supplicate and beg Allah Almighty for forgiveness with a promise to avoid the violation in future namely in cases where it is avoidable.  Such people need to make sure not to forget their taubah.

But first and foremost, oath breakers must take care of whichever of penalties (stated in the Noble Quran) they can practically handle within their personal situation.  Avoiding the penalties for flimsy reasons after violating a Quranic injunction is very inappropriate in the Sight of Allah Almighty and He is Watcher over everything and Knower of everything.

After making such a mistake and if the person does not have any contacts outside, is it okay for them to atone by sending money to the Masjid with request to feed the poor?

Yes, I am personally quite sure that would be fine.  Just be sure as best as you can that the Masjid or Islamic Institute you send the money to is a reliable outlet.  It would be better to give them the money in person and tell them what it is for.

If they are told what the money is for then they mix hadith rules with it and make it hard.  For oath breaking sin Allah has said in the Quran to feed 10 people with edible food we have in our homes.  If there is some hadith, I don't know, which may say to feed 20 or 30 people, then those hadith following people will demand more money.  So, how about calculating the money for 10 meals and giving it to the Masjid as "zakah for feeding the poor."

I get your point and unfortunately that issue does exist in some places where they are a bit pushy on that front.  I didn't think of that.  Well, in that case just send the money or give it in person the way you suggested to a Masjid or Islamic Center you trust the most.

That Hadith ruling needs to be trashed immediately because the Noble Quran has already stated that missing Ramadan fasts requires to do qada fasts later on by the same person to compensate for the missed fard Ramadan fasts.  There is absolutely no concept with Allah about one person performing any worship for another person, including fasting.  We can make du'a for other people but we cannot perform worship for them. 

"And no burdened soul can bear another's burden, ....  He who grows (in goodness), grows only for himself, (he cannot by his merit redeem others).  Unto Allah is the journeying."  35:18  Surah Fatir.

True.  So if a person who has missed his fasts and passed away without making up for it, has passed with a responsibility he or she did not fulfill.  Can we make du'a for such a person to Allah for forgiveness?

Yes of course we can make du'a for such a person, as long as we know that the deceased was a believer in Allah alone.  We are not to make du'a only for those who passed away as disbelievers in Allah.
